If a family member dies as the result of the negligent or intentional actions of another person, the surviving family members have a right under the Code of Virginia to bring a wrongful death lawsuit. 

That right is created by Virginia Code Section 8.01-50, and the purpose is to compensate the surviving family members for the loss of their loved one. The damages available are defined in the Virginia Code, and the order of beneficiaries entitled to recover are defined as well in Virginia Code Section 8.01-53.

This is an oversimplification, but if a family member passed away because of the carelessness or intentional actions of another, you may have the ability to bring a lawsuit against the responsible person whose actions or carelessness took a life, and you should speak with an attorney.
